Short Term Rental Agreement Bevan's Legacy Auto Co.

This Short-Term Rental Vehicle Agreement ("Agreement") is made between Bevans Legacy Auto Co LLC ("Owner") and the undersigned customer ("Renter"). This Agreement outlines the rental terms of the vehicle described below.

1.1 Base Rental Rate

The daily or weekly rental rate agreed upon at booking applies.


1.2 Mandator Roadside & Maintenance Service Fee - $20/week

A required $20 per week provides the Renter with access to BL Auto's in-house roadside assistance and minor maintenance program. The fee is:

  • Mandatory for all rentals

  • Non-refundable

  • Charged for the availability of services, not usage

  • Billed weekly or per portion of a week


2. Roadside Assistance & Minor Maintenance

Bevans Legacy Auto Co. provides in-house basic roadside and maintenance support. These services are performed by Bevans Legacy Auto's Mobile Mechanic team.


2.1 Services Included

  • Tire changes

  • Tire plug repair (temporary flat repair)

  • Jumpstarts

  • Oil changes

  • Lockouts

  • Air/tire pressure correction

  • Minor fluid top-offs (washer fluid, coolant top-off if safe)

  • Diagnostic scanning (OBD2 + ABS if applicable)

  • Bulb replacement

  • Wiper replacement


2.2 Services NOT Included

These will incur additional charges:

  • Brake system repairs

  • Suspension repairs

  • Engine repairs

  • Transmission repairs

  • Towing services

  • Mechanical work requiring specialized equipment or advanced tools

  • Issues caused by renter misuse or negligence


2.2 Renter Repair Instructions

Renter is not permitted to:

  • Perform repairs on the vehicle

  • Take the vehicle to another mechanic

  • Approve repairs on behalf of Bevans Legacy Auto Co.

  • Tamper with any Bevans Legacy Auto Co. equipment or GPS devices


Unauthorized repairs are strictly prohibited and will not be reimbursed.


3. Security Deposit

Deposit Amount: $75.00

Deposits serve as an administrative, setup, and incident coverage fee.

Deposit may be used for:


  • Damages

  • Late fees and late return fees

  • Unpaid charges

  • Cleaning fees

  • Fuel discrepancies

  • Policy violations


Deposit is not returned until full inspection is completed, the rental period has ended, and the vehicle has been safely returned.


Deposits can be refunded in the event of cancellation within 48 hours of booking BEFORE vehicle has been placed into the renter's possession. Less than 48 hours and 50% of the deposit will be forfeited.


4. Renter Responsibilities

Renter agrees to:


  • Maintain fuel level

  • Keep the vehicle clean

  • Lock the vehicle

  • Prevent unauthorized drivers

  • Do not smoke or transport pets unless approved

  • Operate the vehicle safely and lawfully

  • Notify Bevans Legacy Auto Co. immediately of any mechanical issue or warning light

  • Stop driving if the vehicle becomes unsafe

  • Follow Bevans Legacy Auto Co.'s instructions for roadside situations

  • Return the vehicle in the same condition as received (normal wear accepted)

  • Pay all rental fees, service fees, and usage charges


4.1 Renter's Responsibility for Vehicle Operation and Damages

The Renter acknowledges full responsibility for the operation of the vehicle during the rental period. The Owner shall not be held liable for any bodily injury, property damage, or loss arising from the Renter's operation of the vehicle, except as required by law. The Renter agrees to indemnify and hold harmless the Owner against any claims, liabilities, or expenses resulting from the use or misuse of the vehicle.


5. Fuel Policy

The vehicle must be returned with the same fuel level it was received with. A $50 refueling fee will apply otherwise.


6. Mileage Policy

Unlimited mileage until otherwise stated in writing.


7. Prohibited Uses

Renter shall not:


  • Race

  • Off-road drive

  • Tow items

  • Operate under the influence

  • Disable GPS

  • Sublease the vehicle

  • Rideshare (unless expressly permitted)


Violation results in termination and forfeiture of the deposit.


7.1 Renter Requirements

  • Valid driver's license matching booking name

  • Proof of insurance required before vehicle release


7.2 Permitted Use and Driver Eligibility

Only licensed drivers 25 years of age or older may operate the vehicle. The Renter agrees not to permit any unlicensed or unauthorized drivers to use the vehicle. The vehicle shall not be used for ANY illegal purposes, including but not limited to the prohibited uses listed above.


8. Late Payment & Repossession Clause

Late Payments

All rental and rent-to-own payments are due on or before the agreed due date, each Friday, unless otherwise discussed with the financing manager. A late fee of $25 per day will apply to any payment not received by 12 PM CST on the following day (Saturday).


Failure to Pay/Breach of Agreement

If the Renter fails to make payment, maintain required insurance, or otherwise violate this Agreement, Bevans Legacy Auto Co. reserves the right to immediately terminate the Agreement.


Repossession

In the event of non-payment, default, no insurance, or failure to return the vehicle at the scheduled time, the vehicle may be electronically disabled and repossessed without prior notice, in accordance with Tennessee law. The Renter will be responsible for all costs of repossession, towing, storage, legal fees, and any outstanding rental balances.


Reporting of Non-Return

Vehicles not returned on time and without communication will be reported as stolen property to law enforcement after 24 hours.


9. Late Return Policy

Renter acknowledges:


  • Vehicle must be returned at the same time of day as pickup.

  • (30) minute grace period for late returns

  • Late returns after the original pickup time and grace period will incur an additional full day's rental charge and any applicable late fees

  • Deposit forfeited

  • $25/hour late fee may apply

  • Vehicle reported stolen after (24) hours late


These charges ensure availability and scheduling for all customers.


9.1 Early Pickup

Depending on schedule availability and prior approval, you can pay for early pickups before 7:00 AM at the discretion of the owner.


9.2 Early Returns

No refunds for early returns.


10. Damage, Cleaning, and Violations

Renter is responsible for:


  • Any damage not present at checkout

  • Interior/exterior excessive dirt

  • Smoking or vape odor ($250 fee)

  • Lost keys

  • Toll violations, tickets, towing fees


Bevans Legacy Auto Co. can provide before-and-after photos for documentation.


11. Damage & Cleaning Fee Schedule

  • Excessive dirt: $35-$85

  • Smoke/vape odor: $250

  • Pet odor/hair: $150

  • Stains: $75+

  • Lost key: $350

  • Body damage: Repair estimate

  • Flat tire: Renter is responsible


11.1 Damage from Negligence Clause

The Renter is responsible for all damage caused by misuse, neglect, failure to maintain fluid levels, failure to report warning lights, or continued operation of the vehicle after a mechanical issue arises.


11.2 Damage and Refund Policy

In the event that the rental vehicle is returned with any form of damage-cosmetic, mechanical, or structural-whether reported or unreported, the renter forfeits any right to a rental refund, regardless of insurance coverage.


All rental payments are final once the rental period begins. No refunds will be issued if damage is discovered upon return or during the rental period.


Any insurance claims must be processed independently, and do not entitle the renter to reimbursement of rental fees from Bevans Legacy Auto Co.


12. Payment Authorizations

Renter authorizes Bevans Legacy Auto Co. to charge the card(s) provided for:


  • Rental fees

  • Roadside and Maintenance fees

  • Extensions

  • Fuel replacement

  • Damage or Cleaning fees

  • Towing/impound

  • Deposit

  • Smoking/pet violation fees

  • Administrative fees for claims

  • Any unpaid balance under this Agreement


Payment authorization survives the rental period.


13. Insurance Requirements

Insurance Disclosure Notice:

  • The State of Tennessee requires that we inform you:

  • Your personal automobile insurance policy may provide coverage while operating a rental vehicle, but not all policies offer this coverage. You should contact your insurance provider to verify your liability, comprehensive, and collision coverage during the rental period.

  • Bevans Legacy Auto Co requires that all renters carry insurance coverage that includes a collision damage waiver and liability protection. This can be purchased from Bonzah or another approved provider before rental.

  • Bevans Legacy Auto Co is not an insurance company and is not responsible for claims or disputes involving third-party coverage, including Bonzah. Failure to provide proof of required coverage will result in cancellation or delay of your rental without refund.


Insurance Requirement Clause

Mandatory Insurance Coverage

As a condition of renting or operating any vehicle from Bevans Legacy Auto Co, the Renter is required to purchase and maintain active insurance coverage through Bonzah, which includes a Collision Damage Waiver (CDW) and liability protection for the duration of the rental period. The Renter agrees to:

  • Purchase Bonzah coverage at the time of booking or before vehicle pickup

  • Provide proof of purchase (policy number and confirmation) before the rental period begins, or provide proof of insurance company coverage for the vehicle

Acknowledge that failure to maintain this coverage or provide proof of such will result in cancellation of the reservation or refusal of vehicle delivery without refund.


Understand that Bevans Legacy Auto Co is not liable for damages, losses, or liability that occur if the Renter fails to activate or maintain proper coverage through Bonzah or another approved provider.


Proof of insurance must match the Driver's License name.


If you rent longer than 30 days:

Renter MUST maintain full coverage insurance (liability + collision + comprehensive) throughout the entire RENTAL or RENT-TO-OWN period.


Bevans Legacy Auto Co. LLC must be listed as a "Loss Payee" on the policy. Proof of insurance is required before possession of the vehicle and updated upon policy changes.


The Company (Owner) is not liable for any claims, damages, or losses not covered by the Renter's insurance.


Failure to maintain coverage will result in immediate termination and repossession.


Renter agrees that Bevans Legacy Auto Co. is not responsible for claim processing.


Insurance Coverage Acknowledgment

The Renter acknowledges that vehicle rental does not include insurance coverage by default. Renter has the option to purchase supplemental rental insurance with collision/damage waiver coverage through Bonzah, a third-party provider. It is the responsibility of the Renter to review, understand, and accept the terms provided by Bonzah before purchase.


Waiver of Liability

If Renter chooses to purchase insurance coverage through Bonzah or any third-party insurance provider, Renter agrees to hold Bevans Legacy Auto Co LLC. harmless from any disputes, delays, or claim denials that may arise from the third-party insurance provider. It is the Renter's responsibility to understand what is and is not covered under said policy.


If renter's insurance denies any claim, the renter is financially responsible.

Do you have insurance, or will you use Bonzah? *
I will use my own personal auto insurance and will provide proof before rental.
I have purchased coverage through Bonzah and will provide confirmation before rental.


13.1 No-Insurance Fee

Renter is required to maintain active auto liability insurance throughout the rental period. If Renter does NOT have active insurance at the time of rental, a $50.00 per week Uninsured Renter Fee will automatically be added to the weekly rental charges.


This fee:

  • Is non-refundable

  • Applies to every week or portion of the week rented

  • Ends immediately once valid insurance is provided


Renter must submit updated insurance proof within 24 hours of obtaining coverage.


13.2 Weekly Rate Increases for Extensions

Short-term rental extensions will follow a tiered pricing structure:


  • Each additional rental week increases the weekly base rental rate by $15.00

  • The increase continues for each consecutive week rented

  • If the renter wishes to avoid incremental weekly increases, they may request to switch to the Rent-to-Own Program, which offers stabilized payments


Example:

Week 1: $300

Week 2: $315

Week 3: $330

Week 4: $345, etc.


This encourages timely returns and prevents long-term renters from remaining on short-term pricing.


14. Mechanical Condition

Bevans Legacy Auto Co. performs its own minor maintenance during the rental period. This means:

  • Renter must NOT ignore warning lights

  • Renter must contact Bevans Legacy Auto Co. immediately

  • Bevans Legacy Auto Co. will dispatch a mechanic or instruct the renter to stop driving and go to an approved mechanic

  • Continuing to drive an unsafe vehicle is renter negligence


Vehicle is rented to the Renter in safe, operable condition.

After delivery, the Renter is responsible for all major maintenance and wear-and-tear issues if kept longer than a (30) day rental period.


Renter acknowledges that the Company is not financially responsible for mechanical conditions or inconvenience costs that occur during the rental period and/or in the renter's possession.


14.1 No As-Is Clause

We maintain and service our vehicles internally and provide minor roadside and maintenance care for renter safety.


This Agreement reflects Bevans Legacy Auto Co's commitment to mechanical upkeep.


14.2 Renter Maintenance Responsibility

If renting for more than 30 days, all repairs, maintenance, and mechanical issues—whether minor or major—are the financial responsibility of the Renter.


15. Vehicle Condition Acceptance

Renter certifies:

  • Vehicle was inspected at pickup

  • Condition is acceptable

  • All existing damage was photographed


Renter must report mechanical concerns within 30 minutes of pickup.


Failure to report — acceptance that the vehicle is in good working condition.


16. Return Condition Requirements

Renter must return the vehicle:

  • Clean

  • Undamaged

  • With the same fuel level

  • Without personal items


Failure to meet these requirements and/or excessive dirt, stains, or damage will result in cleaning/damage fees.

17. No-Refund Policy

All rental payments are final and non-refundable once the vehicle is released into the renter's possession.


No refunds will be issued for:

  • Early returns

  • Trip cancellations

  • Unused days

  • Dissatisfaction after pickup

  • Failure to read or understand the terms


17.1 No Expectation of Credits Clause

All payments made under this Agreement are non-refundable. No repair issues, mechanical failures, or dissatisfaction with vehicle condition will qualify for payment refunds, adjustments, or credits.


17.2 Final Payment Policy

Payment for the rental is considered FINAL and non-refundable once the vehicle is released to the renter. This applies regardless of whether the vehicle is returned early, damaged, or if the renter is unable to use the vehicle for the full duration.


18. GPS Tracking Consent

Renter acknowledges the vehicle is equipped with GPS tracking, including:

  • Location

  • Movement

  • Ignition status


GPS is used for:

  • Safety

  • Theft recovery

  • Contract enforcement


Tampering fee: $500 + termination + police report.


Renter acknowledges and consents to continuous GPS monitoring.


19. Liability

ALL VEHICLES ARE DEEMED SAFE, LEGALLY OPERABLE, AND MAINTAINED BEFORE DELIVERY.


Renter is liable for:

  • Negligence

  • Theft

  • Hit-and-run

  • DUI

  • Unauthorized drivers

  • Towing or impoundment


20. Indemnification

Renter agrees to indemnify and hold harmless Bevans Legacy Auto Co. from all:

  • Claims

  • Losses

  • Damages

  • Legal costs

  • Third-party claims

arising from the use of the vehicle.


21. Identity Verification Requirements

Vehicle will not be released until the renter provides:

  • Front/back of ID

  • Selfie holding ID

  • Last 4 of the payment card

  • Signed payment authorization


22. Chargeback Protection Statement

By signing, Renter agrees:

  • The vehicle was delivered in acceptable condition

  • Renter physically received and operated the vehicle

  • Renter had the opportunity to inspect the vehicle at pickup

  • All rental fees are non-refundable once the rental begins

  • Filing a chargeback after services were rendered constitutes fraud


Bevans Legacy Auto Co. may pursue legal action for fraudulent chargebacks.


False disputes may be pursued through:

  • Collections

  • Civil claims

  • Law enforcement (if applicable)


23. Rent & Restore™ Optional Membership

Bevans Legacy Auto Co. offers renters access to the Rent & Restore™ Financial Education Membership, which provides:

  • Early credit education resources

  • Budgeting worksheets

  • General financial knowledge tools

  • Optional third-party support resources

  • Monthly progress check-ins upon request


This program is:

  • 100% optional

  • Not required for rental approval

  • Not a credit repair, debt relief, or advisory service

  • A financial education membership only


23.1 Membership Fee

The Rent & Restore™ Financial Education Membership Fee is:

  • $30.00 per month, billed separately

  • Non-refundable

  • Charged only if the renter opts in


23.2 Customer Choice Form Required

All renters must complete the Customer Choice Form, indicating:

  • "Yes, I want Rent & Restore" or

  • "No, I decline Rent & Restore"


Declining the program will NOT affect rental eligibility.


24. Acknowledgment of Agreement by Payment

By making any payment — including deposits, rental fees, administrative fees, or other related charges — the Renter acknowledges that they have read, understood, and agreed to all terms and conditions of this Rental Agreement.


Payment constitutes full acceptance of this Agreement and its provisions, including but not limited to: refund policies, late return fees, insurance requirements, liability, and dispute resolution terms.


The Renter further agrees that initiating payment through any method (credit/debit card, ACH, PayPal, or other electronic means) serves as an electronic acknowledgment and binding acceptance of this Agreement under the Tennessee Uniform Electronic Transactions Act (T.C.A § 47-10-101 et seq.).


25. Governing Law

This Agreement is governed by Tennessee law. Any disputes shall be handled in Davidson County, Tennessee.


Legal Disclaimers & Responsibilities:

  • Renter is responsible for any and all maintenance during rentals exceeding 30 days.

  • Renter is liable for tolls, tickets, towing, and related fines.

  • Renter assumes responsibility for theft, loss, or damage caused by negligence or misuse.

  • Damage such as dents, scratches, or interior wear will be charged accordingly.

  • Unreturned vehicles may be reported stolen. Legal action may be taken.

  • Unpaid balances are subject to collection efforts and may affect credit.


Additional Legal Terms:

  1. Accident Reporting: All accidents must be reported to Bevans Legacy Auto Co. LLC and law enforcement immediately.

  2. Unauthorized Drivers: Only the renter listed may drive the vehicle.

Prohibited Use: No racing, off-roading, towing, intoxicated driving, or illegal activity.

  1. Hold Harmless Clause: Bevans Legacy Auto Co. LLC is not liable for indirect or consequential damages.

  2. Additional Insured: Bevans Legacy Auto Co. LLC must be listed as "additional insured" or "Loss Payee" on the renter's insurance policy when applicable.


Revisions to this Agreement

We may modify this Agreement at any time, with or without notice.


Acknowledgment & Signatures

By signing, Renter agrees to all terms.

I, Christopher Bevans, as Owner of Bevans Legacy Auto Co., confirm that I have signed and agreed to this contract on today. This agreement becomes effective upon Renter's signature.
