Effective Date: JANUARY 2025

By renting a vehicle from Bevans Legacy Auto Rentals, you (“Renter”) agree to the following terms:

1. Rental Eligibility

• Renter must be at least 25 years old with a valid driver’s license.

• Proof of insurance is required. Bonzah coverage with Collision Damage Waiver is mandatory unless otherwise approved.

2. Payments & Fees

• All rental fees must be paid in advance through our secure checkout system.

• A non-refundable $75 deposit applies for short-term rentals.

• Rent-to-own contracts include a $100 administrative fee.

• Late returns or early pickups outside approved hours will result in additional daily charges.

3. Pickup & Return Policy

• Vehicles must be returned at or before the same time they were picked up.

• (30) minute grace period for late returns, returns after the scheduled time AND allotted grace period will incur an additional full day’s rental charge.

• Vehicles returned after 3:00 PM (or picked up before 9:00 AM) may also incur a full day charge unless agreed upon in writing by Management.

• $25/hour late fee may apply

• Vehicle reported stolen after (24) hours late 

These charges ensure availability and scheduling for all customers.

4. Vehicle Condition & Liability

ALL VEHICLES ARE DEEMED SAFE, LEGALLY OPERABLE, AND MAINTAINED PRIOR TO DELIVERY

• Vehicles must be returned in the same condition as provided.

• Excessive dirt, stains, or damage will incur fees.

• The Renter acknowledges full responsibility for the operation of the vehicle during the rental period.

• The Owner shall not be held liable for any bodily injury, property damage, or loss arising from the Renter's operation of the vehicle, except as required by law.

• The Renter agrees to indemnify and hold harmless the Owner against any claims, liabilities, or expenses resulting from the use or misuse of the vehicle.

• Failure to return the vehicle on time may result in the vehicle being reported stolen.

5. AS-IS Condition and Renter Responsibility

The vehicle is delivered to the Renter in safe, operable condition.
After delivery, the Renter is responsible for all minor maintenance and wear-and-tear issues, including but not limited to:

• tire pressure or flat tires

• bulbs, fuses, wipers

• battery issues

• fluids and oil levels (FOR RENTALS EXCEEDING 14 DAYS)

• cosmetic issues

Renter acknowledges that the Company is not responsible for minor maintenance, inconvenience costs, or small mechanical issues that occur during the rental period unless caused by a pre-existing condition known to the Company.

If renting longer than 30 days, ALL repairs, maintenance, and mechanical issues—whether minor or major—are the financial responsibility of the Renter unless directly caused by Company negligence prior to rental.

6. Damage and Refund Policy

The Renter is responsible for all damage caused by misuse, neglect, failure to maintain fluid levels, failure to report warning lights, or continued operation of the vehicle after a mechanical issue arises.

In the event that the rental vehicle is returned with any form of damage—cosmetic, mechanical, or structural—whether reported or unreported, the renter forfeits any right to a rental refund, regardless of insurance coverage.

 

All rental payments are final once the rental period begins. No refunds will be issued if damage is discovered upon return or during the rental period.

 

Any insurance claims will be processed independently, and do not entitle the renter to reimbursement of rental fees from Bevans Legacy Auto Co. and may still result in funds owed due to damages incurred by the renter.

6. GPS Tracking and Privacy Disclosure

• The vehicle is equipped with a GPS device for the purpose of asset recovery, maintenance tracking, mileage reporting, payment enforcement, and safety.

• GPS data may be monitored at any time at the discretion of the Company.

• Tampering with, removing, or damaging the GPS device is strictly prohibited and will result in fees, contract termination, and possible legal action.

Renter acknowledges that:

The vehicle may be equipped with a remote engine disable system, used ONLY when:

• Payments are overdue;

• The vehicle has not been returned;

• The vehicle is reported stolen or missing;

• The vehicle violates safety or contract conditions.

The device will never disable the engine while the car is in motion; disablement occurs only when the car is parked.

GPS and telematics are used SOLELY for business purposes, including Mileage verification, Maintenance tracking, Asset protection, Safety monitoring, Payment compliance, and Recovery in case of theft. No audio or video surveillance is used.

7. Payment Enforcement & Communication

The renter authorizes Bevans Legacy Auto Co. to charge their card for any amounts due under the Rental Agreement, including but not limited to:

Rental fees, Roadside and Maintenance fees, Extensions, Fuel replacement, Damage or Cleaning fees, Towing/impound fees, Deposit, Smoking/pet violation fees, administrative fees for claims, Tolls, and Any unpaid balance under this Agreement

 

Payment authorization survives the rental period.

If payments become delinquent, the Company may:

• Activate reminders

• Send notices of past due amounts

• Use GPS and telematics to locate the vehicle

• Engage the engine disable system once legally allowed

Failure to communicate will accelerate contract enforcement.

8. Insurance & Liability​

Insurance coverage is including in both the standard and premium package. However, anything that is done out of negligence to the vehicle or done illegally in the vehicle will be the sole responsibility of the renter. 

• Bevans Legacy Auto Rentals is not responsible for damages or losses beyond those covered by our insurance or caused by our own negligence. 

 

7. Refund Policy

• Rental fees are non-refundable once the rental period begins. NO EXCEPTIONS.

• Refunds are not provided in cases of damage, loss, or breach of contract.

8. Contract Modifications

Bevans Legacy Auto Rentals may update these Terms & Conditions as necessary to comply with law, insurance requirements, or business operations. Renters will be notified of changes in writing (via email, text, or on the website), and continued payments or use of our services constitutes acceptance.

9. Governing Law

This agreement shall be governed by the laws of the State of Tennessee. Any disputes will be resolved in Davidson County through arbitration or small claims court, as applicable.

10. No Financial or Credit Advice

Bevans Legacy Auto Rentals does not provide financial, legal, tax, or credit advisory services. Any financial education resources offered through optional programs are general and educational in nature and are not a substitute for professional advice. Renters are encouraged to consult with a qualified professional regarding their personal financial situation.
